Contribution to shipment costs: The exact shipping charges payable by you are shown in your basket before you confirm your purchase. The amount calculated is based on the weight of your order, so there is no surprise awaiting you when you finish placing your order online. A flat-rate contribution is charged which is not based on the weight of the parcel.

Delivery information

To ensure soonest delivery, it is preferable to use an address to which delivery can be made during working hours. In Stage 2 of your order, please don’t hesitate to give us any additional information (Door code number, person to be contacted in the event of your absence, etc.)

If the product you have received has been damaged in transit, make a note of this in the "customer reservations" section of the delivery note supplied by the carrier. Don't forget to sign it. Notify us of the problem on the actual day of delivery or, at the very latest, the first working day following delivery. We will then take care of all other formalities.

If you have received a product that is different to the one you ordered, or if an item is missing, you must first make a note of this on the delivery note supplied by the carrier. Then notify us of the error on the actual day of delivery or, at the very latest, the first working day following delivery. We will then rectify the error as soon as possible.

Regulations outside the EU (areas  5, 6, 7, 8 and 9)

For any deliveries outside the European Union (except: United States, Canada, Switzerland) we would remind you that Customs Duties and taxes may be required on delivery of your parcel. We recommend you to contact the Customs office in the country of destination for further information.

Also, certain countries impose special procedures or forbid the import of certain products. For this reason, all customers must inform themselves concerning the legal requirements of the countries to or from which they wish to import or export goods. It is your responsibility not to order products which may be forbidden imports.

Tall our products are delivered in top-quality American-made boxes. All modern techniques are used so that the products travel in maximum safety conditions.

For increased security, our packages are sealed. When the packages are closed, seals bearing the CadeauxDeProvence.com logo are affixed enabling any opening of the original packaging to be seen.

E.B.Com Sarl specifies that it is not possible to purchase any goods without accepting the general sales conditions stipulated below.

ARTICLE 1- Purpose.

The present contract fixes the rights and obligations of E.B.Com Sarl and the consumer in the context of the sale of goods offered by E.B.Com Sarl on its web site.

The general sales conditions constitute all the rights and obligations of the parties, no other General Conditions can be integrated into these.

ARTICLE 2-Applicable law

The rights and obligations of the parties are governed under French law.

ARTICLE 3 - Acceptance of the present general conditions

The fact that a user fills in a purchase order present on the web-site and confirms the order (by clicking on the "Confirm order" button, then in the SSL part by clicking on the "Validate" button), implies full and complete acceptance of the present Sales Conditions.

ARTICLE 4-Confirmation of Order and Confirmation of Contract

The web-site contains at all times a commercial offer of sale for products which is not considered, from a legal point of view, as a permanent offer. Therefore a contract is only concluded if it is confirmed by E.B.Com Sarl.

The possible refusal to accept an order may be confirmed by return mail 24 working hours at the latest. Furthermore E.B.Com Sarl reserves the possibility of not registering a payment and therefore of not confirming an order or any reason whatsoever.

ARTICLE 5- Characteristics of goods and services offered

E.B.Com Sarl informs the consumer of all the main characteristics of the proposed goods.

These characteristics are shown with supporting photographs and texts illustrating the offer. We request our clients to read the characteristics described in these texts, carefully.

Geographical zone of delivery E.C, U.S.A., Canada, Switzerland (see countries listed in the purchase order section or Your guarantees section); however for countries that are not listed, refer to the section "Contact".

ARTICLE 6- Prices of products - VAT - Charges.

The prices indicated are those in effect at the time of browsing the web site, of the confirmation by the customer of the order and will be applied for the invoicing.

The sales prices are expressed in Euros and for certain countries in US Dollars. Prices expressed in dollars are converted at the current rate. Owing to the exchange rate applied by your bank, the amount which you will be debited may be different from that shown when viewing pages on our site.

The transaction will be made in  Euros only.

Any exchange rate variation will be exclusively borne by the customer.

Just for your information, a module for conversion into other currencies is available, by simple request of the consumer on the product page - (click on the checkbox).

The applicable prices are calculated including all taxes, with French VAT (applicable on the day of the order) for the consumer residing in the European Community (EC);

The applicable prices are calculated excluding French VAT for the consumer residing outside of the European Union (EC).

Companies located within the EEC and having a Euro VAT number shall benefit, after giving their number, from VAT exemption ("Contact" page).

Excise duty on wine and alcohol, for their circulation on French territory, shall be paid by E.B.Com Sarl.

In the member countries of the European Community , the products are sold including French tax.

For the countries outside of the European Community , the products are sold exempted from French tax, local taxes (if any) are charged to the purchaser. The customs taxes (customs duties and related formalities) will be charged exclusively to the consumer.

The consumer then undertakes to check the conformity of the delivery according to the legislation applied in the country it was shipped from.

However, for the following countries: United States of America, Canada, Switzerland, duties and taxes shall be included in the prices mentioned on the purchase order.

You should add to the price indicated on the product page, the delivery charges calculated according to choice of transport, weight of package and destination; this function shall be carried out from the "Purchase Order" page.

ARTICLE 7 - Acceptance of offer.

The sale becomes final after acceptance by Atos SIPS , the services for the transaction of secured on-line payments. The acceptance and confirmation of the order are carried out by data input on the "Order" page. These data appear on a recapitulative screen which includes the explicit mention of the firm engagement of the purchaser.

ARTICLE 8 - Retraction.

The customer may retract his order during the 7 working days as of the delivery date of the ordered goods, except for perishable products. Transport costs and other costs (taxes, duties...) for the return of products to E.B.Com Sarl are charged to the purchaser. Only the repayment of products is due, within a maximum period of 30 days as of the receipt of the products by E.B.Com Sarl, provided that no anomalies or hidden defects are noted on the products. Where appropriate E.B.Com Sarl reserves the right not to repay the customer.

The product should be sent back in its original packaging, without alteration of any kind.

The customer may also choose to exchange the product.

ARTICLE 9 - Order Confirmation

To be quite sure of the consumer's wishes E.B.Com Sarl undertakes to confirm all orders.

The mention of the ordered goods, their price, terms of payment and also the mode of delivery, shall be included on this confirmation by e-mail within 24 hours as of the said order.

These order confirmations shall be filed at E.B.Com Sarl's headquarters and shall be considered as proof of the nature of the agreement and of their date.

ARTICLE 10 - Payment / Invoice

For each product offered for sale, the consumer has several possibilities of payments as follows :

Immediate payment by credit card (Carte Bleue, Visa, Master Card), made secure by SSL technology. E.B.Com Sarl uses the S.I.P.S. secured payment system. The credit card number and the validation date are transmitted in an encrypted form, this transaction takes place on the bank server. E.B.Com Sarl. E.B.Com Sarl never receives this data.

Payment by bank transfer (Your guarantees / Payment page)

Payment by bank cheque, only drawn on a French bank.

Cash on Delivery (Collect): You can choose this method of payment in Stage 1 of your order at an extra cost of 7.6 €. This payment method is only valid for delivery in France and Corsica.

The consumer attests having the necessary authorisations to make the payment he has chosen.

In the context of a payment by credit card, the payment order can be revoked in case of fraudulent use of the card, in accordance with the agreement made between the consumer and his bank.

On request an invoice shall be sent to the address of your choice. This request should be made by e-mail ("Contact" page)

ARTICLE 11 - Nominative information

To ensure proper processing of the order, collected nominative data shall undergo computer processing, the consumer acknowledges having knowledge of this.

E.B.Com Sarl undertakes not to communicate this information to third persons.

The consumer also has a right of access and rectification with regards to all information concerning him and present in the company files. To exercise this right please send a letter to :

ARTICLE 12 - Transport-Delay-Delays :

The products are delivered to the place of delivery indicated in the purchase order within a delay of 3 to 4 days in the EC and 10 to 15 days outside of the EC. (on the basis of working days from Monday to Friday (except for holidays) as of the confirmation of the order, except if the payment has not been made for any reason whatsoever). The delays given by E.B.Com Sarl to the customer vary according to the country. These are given as an indication on the E.B.Com Sarl web-site, E.B.Com Sarl cannot be responsible for exceeding the indicated delays given on the web-site or at the time of the confirmation of the order. If the recipient - or a person able to take possession of the products - is absent at the time of the delivery, the carrier shall leave a notice of visit to the address for delivery given by the customer. Under no circumstances E.B.Com Sarl shall be responsible for a possible deterioration of the products in case of late collection of the said products from the carrier, or non collection of the products by the customer.

We inform our customers that it is compulsory that all the products destined for countries outside of the EC be accompanied by an invoice.

ARTICLE 13 - Transfer of risks :

The transfer of risks concerning products takes place when they are handed over by E.B.Com Sarl to the carrier. The products travel at the customers' risk.

ARTICLE 14 - Reservations

The customer can only enter a reservation upon delivery of products when delivery differs in quantity indicated in the order, or in the case where a package containing products is heavily damaged. These reservations should be entered in writing to the carrier at the time of delivery, or at the latest 24 hours after this delivery. A copy of these reservations should be sent to E.B.Com Sarl (by electronic mail or fax) 24 hours at the latest after these reservations have been made. It is up to the customer to supply with this transmission to E.B.Com Sarl confirmation by the carrier of the reality of these reservation.

If the above procedure has been complied with and it is therefore proved that the reservations are due to the deterioration of the package and products, E.B.Com Sarl, at its choice shall reimburse the customer the price paid or shall make a further delivery of similar products.

If the delivery is not conform quantitatively to the order, E.B.Com Sarl shall only repay the price difference between the ordered products and those delivered, only, of course, if the delivered products are lower in price to those ordered and paid. No reservations can be made for taste, appearance, colours, shapes or the measurements of the products.

ARTICLE 15 - Guaranties-Limitation

The purchaser benefits from the legal measures as to the guarantee against hidden defects. Excluded form this guarantee are the use-by date, abnormal use of the product through negligence or fault on the part of the consumer, the replacement of articles related to normal wear and tear of the product as well as the non functioning or damage related to an accident or natural phenomena, the inappropriate storage of products.

E.B.Com Sarl guarantees that the products are made in France (Provence Alpes Côte d'Azur region) and that they have undergone all the necessary care in order to ensure their conformity to the description given on the web-site at the date of the order. E.B.Com Sarl also guarantees that the products are of excellent quality and they shall reflect the written description on the web-site. However, taking into account the hand-made nature of certain products, the physical characteristics can vary by 5 %. This is the only guarantee granted by E.B.Com Sarl. No other guarantee written or tacit is granted. In particular, E.B.Com Sarl shall not be able to guarantee that the products meet the specific expectations of the customer.

ARTICLE 16 - Responsibility-Limitation of responsibility

The customer is solely responsible for the choice of the products, of their preservation, as of the delivery and of their use. In this respect, the customer's attention is drawn to the fact that he should not consume the products beyond the delays indicated on the labelling, nor if it seems that the products are deteriorated (due to the heat, problems during transport or any other cause). Under no circumstances can E.B.Com Sarl be held responsible for any damages due to this fact. Likewise E.B.Com Sarl cannot be held responsible for non respect of the legislative or statutory measures in force in the countries where deliveries are made, E.B.Com Sarl being responsible only for complying with French legislation relative to the products.

ARTICLE 17 - Settlement of disputes-Competent Courts.

If a dispute arises from the present contractual relation, the parties undertake, before taking any legal action, to look for an amicable solution.

All disputes arising from the present contract should be referred to the exclusive competence of the Commercial Court of Draguignan (France).
